Terms of Use

These Terms of Use (“Terms”) are issued by SAH GOOD GROUP LLC, doing business as TryTheFit AI (the “Company,” “we,” “our,” or “us”). They govern your access to and use of our website, platform, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must stop using the Services immediately.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and the Company. By creating an account, purchasing a subscription, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms along with our Privacy Policy.

2. Eligibility

To use the Services, you must:

  • Be at least 18 years old, or at least 13 with parental consent.
  • Have the legal capacity to enter into a binding agreement.
  • Use the Services only for lawful purposes.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@trythefit.ai if you suspect unauthorized access. We may suspend or terminate accounts that show signs of unauthorized or fraudulent activity.

4. The Services

TryTheFit AI provides an AI-powered virtual try-on platform that allows you to:

  • Upload photos of yourself or model images and garment images to generate realistic virtual try-on outputs.
  • Create fashion content for personal use, social media, e-commerce, marketing, or branding.
  • Manage and download AI-generated images through your account dashboard.

5. Credits & Subscriptions

  • The Services operate on a credit-based system. Each AI try-on generation consumes 5 credits. If a generation fails, the credits are returned to your balance.
  • Credits are included with your subscription plan and vary by tier (Starter, Pro, Premium, Ultra).
  • Subscriptions renew automatically on a monthly basis unless you cancel before the next billing date.
  • Unused credits do not roll over to the next billing period unless otherwise stated in your plan.
  • All payments are processed through Stripe. By subscribing, you authorize recurring charges to your chosen payment method.

6. Refunds & Cancellations

Payments are generally non-refundable except where required by applicable law. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to the Services until then.

7. Permitted Use

You may use the Services to:

  • Generate virtual try-on images for personal or commercial use.
  • Create marketing, e-commerce, and social media content featuring AI-generated outputs.
  • Share generated images with others, subject to these Terms and your plan's commercial license.

8. Prohibited Activities

You agree not to:

  • Upload or generate content that is illegal, obscene, defamatory, threatening, or that depicts minors.
  • Create deepfakes, non-consensual imagery, or content intended to deceive, harass, or defraud others.
  • Upload images of individuals without their consent or the legal right to do so.
  • Reverse-engineer, decompile, scrape, or attempt to extract the source code or underlying AI models of the Services.
  • Use automated bots, scripts, or other tools to manipulate or excessively burden the Services.
  • Infringe on any copyrights, trademarks, or other intellectual property rights.
  • Resell, sublicense, or redistribute access to the Services.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice.

9. Intellectual Property

  • Our IP: the Services, including all software, trademarks, branding, and AI technology, are owned by or licensed to TryTheFit AI and are protected by intellectual property laws.
  • Your content: you retain ownership of the images you upload. By uploading content, you grant us a limited, non-exclusive license to process it as necessary to provide the Services.
  • Generated outputs: subject to your plan's commercial license, you may use AI-generated outputs for personal and commercial purposes. We retain no ownership claim over your generated outputs.

10. AI Output Disclaimer

AI-generated try-on images are approximations and may not perfectly represent how clothing will look in real life. Results can vary based on image quality, lighting, garment type, and other factors. TryTheFit AI is not responsible for discrepancies in fit, color accuracy, fabric texture, or digital rendering. Generated outputs should not be relied upon as a substitute for physical try-ons when precision is critical.

11. Privacy & Data

Your use of the Services is also governed by our Privacy Policy. We do not sell your personal data. Uploaded images are processed solely to generate your try-on outputs and are not used to train AI models without your explicit consent.

12. Service Availability

We strive to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free operation. We reserve the right to modify, update, or discontinue any feature or aspect of the Services at any time. We will make reasonable efforts to notify users of material changes in advance.

13. Limitation of Liability

To the fullest extent permitted by applicable law, TryTheFit AI and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services. Our total aggregate liability for any claim related to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless TryTheFit AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

15. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the “Effective Date” above and notify you through the Services or by email. Your continued use of the Services after the revised Terms take effect constitutes your acceptance of the changes.

16. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
